What we can't do
The Commission is not a court of appeal. We cannot decide whether a person has been wrongly convicted or has received too long a sentence. We cannot decide whether a convicted person who has had their conviction quashed or sentence reduced should receive compensation; this is a matter for the Scottish Government.
We will not accept a case for review where appeal proceedings are outstanding. We will normally not accept a case for review where the applicant has not attempted to appeal through normal court procedures.
We cannot act as representatives for applicants and we will not take instructions from applicants.
