Appealing our decision
If we have decided not to refer your case to the High Court, and you remain of the view that a miscarriage of justice has occurred, taking account of our reasons for not referring your case, you are not prevented from making a second application to us. However, we may decide not to accept a second application for review where no new issues have been raised. You also have the right to seek a Judicial Review of our decision. If you are unhappy about the conduct of any of our staff or that procedures were not followed then it is open to you to lodge an official complaint by initiating our complaint’s procedures. If you are concerned about the conduct of any of the Members of the Board of the Commission then you have the right to complain to the Standards Commission for Scotland.
